Temporary Foreign Worker Program

Manitoba’s Worker Recruitment and Protection Act

Since April 1, 2009, employers who want to hire foreign workers for Manitoba must register with the Government of Manitoba’s Employment Standards Division. In addition, anyone engaged in foreign worker recruitment in Manitoba must be licenced. The registration and licencing requirements come as a result of Manitoba’s Worker Recruitment and Protection Act (WRAPA) that expands protections for temporary foreign workers and strictly prohibits charging fees to people seeking or finding work.

Employers

Effective April 1, 2009, employers must include a valid and original Certificate of Registration from the Government of Manitoba’s Employment Standards Division when they apply for a Labour Market Opinion (LMO) or an Arranged Employment Opinion (AEO).

A Certificate of Registration from Manitoba does not determine whether an employer is eligible to receive a LMO or AEO confirmation from HRSDC/Service Canada. This decision is made in accordance with the corresponding regulations of the Immigration and Refugee Protection Act.

Third Parties

As of April 1, 2009, anyone who assists a temporary foreign worker or applicant for permanent residence in finding a job in Manitoba or assists an employer in finding a temporary foreign worker or permanent residence applicant for a job in Manitoba must obtain a licence from the Government of Manitoba’s Employment Standards Division.
