Selection Criteria and Conditions of Appointment

Position(s): Legal Member (Chairperson), Medical Member, Community Member
Organization: Canada Pension Plan/Old Age Security Review Tribunals

Essential Qualifications

Applicants must clearly demonstrate on their application that they meet all the following essential criteria. Failure to do so may result in the rejection of their application.

Education

Legal Member

  • Law degree from a recognized university in Canada or equivalency from the National Committee on Accreditation
  • Member in good standing of the Bar of a province/territory

Medical Member

  • Graduation from a recognized college or university or equivalency with a specialization in one of the prescribed related medical professions (Please refer to List of Medical Professions)
  • Qualified to practice in a province/territory
  • Current certification with provincial governing body

Community Member

  • A secondary school diploma (or an acceptable combination of education, training, and/or experience)

Language (All Categories of Members)

  • Official Language proficiency, various linguistic profiles including English essential or bilingual

Experience

All Categories of Members

  • Experience in presenting information

Legal Member

  • Experience in chairing meetings of tribunals, boards, panels, committees or agencies
  • Experience in writing submissions or decisions that pertain to the interpretation of statutes and case law.
  • Experience in representing parties in proceedings before administrative tribunals or regulatory agencies or experience as a member or legal counsel with an administrative tribunal or regulatory agency.

Knowledge

Legal Member

  • Knowledge of the rules of statutory interpretation
  • Knowledge of the principles of natural justice and procedural fairness

  • Ability to communicate effectively, including active listening skills
  • Ability to synthesize and analyse information necessary to writing a decision
  • Ability to provide decision rationale, in writing and in a timely manner (Chairperson only)

Asset Qualifications (All Categories of Members)

Meeting the asset qualifications below is desirable and may be a deciding factor in choosing candidates. Applicants may be appointed to the position even if they do not meet some or any of the asset qualifications.

Education

Community Member

  • Successful completion of post-secondary courses that are applicable to the nature of work within the tribunal e.g. law, medicine, disability studies, social sciences, rehabilitation etc.

Experience

All Categories of Members

  • Experience working with community-based organizations concerned with issues affecting people with disabilities
  • Experience in writing as a member of an administrative tribunal or regulatory agency
  • Experience in orally providing a supporting rationale for decisions, recommendations or findings

Knowledge

All Categories of Members

  • Knowledge of the Canada Pension Plan and The Old Age Security Act

Abilities / Skills

All Categories of Members

  • Ability to communicate in plain language when speaking of, or writing about, legal and medical concepts
  • Ability to use a personal computer for email and word processing

Conditions of Appointment (All Categories of Members)

Security: Reliability Status

Who Can Apply: Must be a Canadian resident

Certifications: Medical members must provide a copy of current certification of registration with a provincial governing body. Legal members must provide confirmation that they remain a member in good standing with their provincial governing body.

Impartiality The selected candidate will be subject to the principles of the Conflict of Interest and Post-Employment Code, the Ethical Guidelines and the Guidelines for the Political Activities of Public Office Holders. Before appointment, public office holders will be required to sign a conflict of interest declaration and a Certification Document, certifying that, as a term and condition of holding office, they will observe the Code and Guidelines. Availability (All Categories of Members):

Must be available for approximately three consecutive days of hearings in a month and must be able to dedicate an additional three to five days to prepare for hearings, travel to and from hearings, draft and review written reasons for decisions and dissenting opinions.

Must be available to attend an initial five-day orientation program in Ottawa, as well as additional seminars scheduled on an ad hoc basis.

Access to technology (All Categories of Members)

  • Must have access to telephone messaging, fax, and email

A variety of assessment tools may be used to screen and assess applicants including reference checks, written tests and interviews.

Applicants who meet the essential requirements will be notified that their applications are being retained.

An inventory of pre-qualified applicants resulting from this process may be used to fill future vacancies.
